1. Who We Are

elebe ("we", "us", "our") is an independent designer brand operating at elebe.ca. We create and sell original work in small runs — printed art, leather goods, headwear, and the sticker art of the "A Filling Blanks Collection" and related series. We are not affiliated with any third-party marketplace, reseller, or distributor unless explicitly stated.

If you purchased from any source other than elebe.ca or an officially announced partner, we have no record of your order and cannot assist with it.

2. Acceptance of Terms

By visiting elebe.ca, browsing content, or completing a purchase, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, please do not use the site or place an order.

We reserve the right to update these Terms at any time. The revised version will be posted here with an updated effective date. Continued use of the site after changes constitutes your acceptance. The Terms that apply to an order are the ones published when that order was placed.

3. Ordering & Payment

Prices are shown in Canadian dollars (CAD) and are set by us at the time of checkout. The price charged is the price our server calculates for the items in your cart; a price displayed anywhere else — an older page, a cached listing, a screenshot — is not an offer and does not bind us.

Payment is processed by Stripe. Depending on your device and browser, that may include card payment, Apple Pay, or Google Pay. We never receive or store your full card number. Card details are entered on Stripe's own payment page and handled entirely by Stripe under their terms and privacy policy.

Placing an order is an offer to buy. A contract is formed only when we accept your payment and confirm the order by email. Until then we may decline any order — for example where an item has sold out between your cart and your payment, where a price or description was wrong, or where we cannot ship to your address.

Stock is held for a limited period while you complete payment. If payment is not completed in that window, the items return to sale and your order is cancelled automatically.

4. Buying Without an Account

You do not need an account to buy. If you check out as a guest, we create a minimal customer record attached to the email address you give us, so that your order has an owner, your receipt can reach you, and we can answer you about it later.

That record is not an account and does not sign you in. It has no password, it does not confirm your email address, and it gives no access to the collection, unlocks, or anything else on this site that requires an account. If you later create an account with the same email address, your existing orders are attached to it.

It is your responsibility to give an address you can actually receive mail at. If you use a private or forwarding email service and it blocks or discards our mail, we have sent your receipt and cannot resend it to somewhere else without being asked.

Account holders: you are responsible for keeping your password confidential and for activity under your account. Tell us promptly at [email protected] if you believe it has been used without your permission.

5. Returns & Refunds

Our products are made in small runs, and several are made or finished by hand. For that reason we do not offer returns, exchanges, or change-of-mind refunds, except in the cases below and except where the law where you live gives you a right we cannot contract out of. Nothing in these Terms removes such a right.

Everything we post is tracked. We do not offer an untracked service at any price or to any destination. A cheaper, untraceable option would save you a few dollars and leave a lost parcel with nobody who can say where it went — so we removed it rather than offer it. Every service shown at checkout carries tracking and carrier coverage, and both the delivery window and the amount covered are shown next to the price before you pay.

We do not refund for: change of mind, buyer's remorse, a size or variant chosen in error, or dissatisfaction with an item that matches its description. Product photographs are representative — variation in colour, grain, and finish between batches is a property of the work, not a defect.

How a refund is paid. Refunds are returned to the original payment method through Stripe, in the original currency. We do not refund to a different card, account, or person. Any difference caused by exchange-rate movement between payment and refund is outside our control.

Chargebacks. If you dispute a payment with your bank or card issuer, we will not dispatch that order while the dispute is open. Please contact us first — almost everything is faster to fix directly, and nothing in these Terms asks you to give up your right to dispute a payment.

6. Digital Pieces & Unlocks

Some purchases include a digital piece added to your collection, and parts of this site can be unlocked through play. Digital pieces and unlocks are a personal, non-transferable, revocable licence to view them on this site. They are not files you own, not a transfer of copyright, and they have no cash value.

Digital pieces are not returnable. Once a piece has been unlocked it has been delivered, and a refund of the order it came with does not automatically remove it. Where an order is refunded in full we may remove any digital piece it included.

We may change, retire, or re-gate any digital piece, game, or unlock at any time. We do not promise that any of it will remain available, and no purchase is a purchase of permanent access.

Attempting to obtain an unlock other than by playing — including tampering with site code or data, or using an automated tool — may result in unlocks being removed and access being withdrawn.

7. Products & Availability

All products are original work produced in limited quantities. We reserve the right to discontinue, modify, or re-price any product at any time without prior notice. A listing on the site does not guarantee availability. If an ordered item turns out to be unavailable after purchase, we will tell you and refund that item in full.

Product images are as accurate as we can make them, but slight variation in colour and texture occurs between batches. This is a feature of work made in small runs, not a defect.

8. Shipping & Delivery

We ship from Canada to the destinations offered at checkout. Shipping is priced by destination, weight, and package size. You choose the destination before you pay, and the services available to you are listed with their price, their delivery window, and the amount the carrier covers, so nothing about carriage is a surprise at the end.

Every service is tracked. We ship nothing untracked. You will be given a tracking number when the parcel is dispatched.

When we ship it. Paid orders are shipped within 3 business days, counted from the business day after payment and excluding weekends. The exact date is written in your order confirmation, so the promise is one you can hold us to rather than one you have to remember. Shipping is not delivery: the carrier's own estimate starts when they take the parcel, and both are shown to you separately.

Delivery estimates are given in good faith and are not guaranteed. The windows shown at checkout are the carrier's business-day estimates and exclude the day of dispatch, weekends, and public holidays. Once an order is handed to a carrier, timing is outside our control. We are not responsible for delays caused by customs, weather, carrier disruption, industrial action, or an incorrect address. Please allow the full window to pass before telling us a parcel is missing — most late parcels are moving, and the tracking will say so.

Duties, taxes, and customs. Orders shipped outside Canada may attract import duties, taxes, or handling fees on arrival. These are set by your country, are not included in the price you pay us, and are your responsibility. We do not mark parcels as gifts and do not under-declare their value. A parcel refused or abandoned at customs is not refundable.

Addresses are checked before you pay. The address you enter is verified against the postal database before payment is possible. Where it is recognised but written differently, you are shown the postal service's version and asked to accept it — that accepted version is the address we ship to, because it is the one a carrier will deliver to. An address we cannot verify cannot be paid for; write to us and we will check it by hand.

What this does not do is know which address is yours. A verified address that is simply the wrong one — an old home, a transposed house number that happens to exist — is still your responsibility, and we cannot reship or refund an order lost to one. Tell us immediately if you spot a mistake: we can usually correct it before the parcel is shipped, and never after.

9. Limitation of Liability

To the maximum extent permitted by applicable law in any jurisdiction worldwide, elebe, its owner, contributors, and any affiliated individuals are not liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising from:

• Your use of, or inability to use, this website;
• Any purchase, delivery, or product received;
• Delays, errors, or failures in shipping or logistics;
• Third-party payment processors, platforms, or services;
• Unauthorized access to or alteration of your data.

Our maximum liability to you for any claim related to a purchase is limited to the amount you paid for the specific item in dispute.

10. Disclaimer of Warranties

This website and all products are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the site will be uninterrupted, error-free, or free of viruses or harmful components. We do not warrant that product descriptions, images, or other content are accurate, complete, or current.

11. Intellectual Property

All content on this site — including artwork, logos, graphics, photographs, text, product designs, and the "A Filling Blanks Collection" identity — is the exclusive intellectual property of elebe or its creator, protected under Canadian and international copyright and trademark law.

You may not copy, reproduce, redistribute, sell, modify, or create derivative works from any content on this site without prior written permission. Personal, non-commercial sharing of product photos with proper credit is welcomed.

Purchasing a physical object does not transfer any intellectual property rights. You acquire the physical object only.

12. User Conduct

You agree not to use this site to:

• Violate any applicable law or regulation;
• Impersonate elebe or misrepresent an affiliation with us;
• Interfere with or disrupt site infrastructure or security;
• Scrape, harvest, or extract data from the site in automated ways.

13. User-Generated Content

The site may, now or in the future, let you submit content — for example, messages sent through our contact form, reviews, comments, images, tags, names, scores, or anything else you upload, post, or transmit ("User Content"). You are solely responsible for your User Content and the consequences of submitting it.

By submitting User Content, you represent and warrant that:

• You own it or have all rights and permissions necessary to submit it;
• It does not infringe the intellectual property, privacy, publicity, or other rights of any person;
• It is not unlawful, defamatory, obscene, hateful, harassing, threatening, deceptive, or otherwise objectionable, and does not contain malware or solicitations.

Licence to us. You retain ownership of your User Content. By submitting it, you grant elebe a non-exclusive, worldwide, royalty-free, sublicensable, and transferable licence to use, host, store, reproduce, modify, display, and distribute that content in connection with operating, promoting, and improving the site and our products. You waive any moral rights in your User Content to the extent permitted by law.

No obligation to monitor; right to remove. We do not pre-screen User Content and are not responsible or liable for any User Content submitted by you or any third party. We may, but are not obligated to, monitor, edit, refuse to post, or remove any User Content at our sole discretion and at any time, for any reason, without notice.

Copyright complaints / takedown. If you believe content on the site infringes your copyright or other rights, email [email protected] with: a description of the work, the location of the allegedly infringing material, your contact information, and a statement that you have a good-faith belief the use is unauthorized. We will review and remove infringing material where appropriate, consistent with the U.S. DMCA and applicable Canadian law.

elebe disclaims all liability for User Content, including any errors, omissions, or losses arising from reliance on content submitted by users. Opinions expressed in User Content are those of the user, not elebe.

14. Indemnification

You agree to indemnify, defend, and hold harmless elebe, its owner, and any affiliated individuals from and against any claims, damages, liabilities, losses, costs, or expenses (including reasonable legal fees) arising out of or related to: (a) your User Content; (b) your use or misuse of the site; (c) your violation of these Terms; or (d) your violation of any law or the rights of any third party.

15. Third-Party Links & Services

This site may link to third-party websites, payment platforms, or social media. These are provided for convenience only. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party site or service. Payments are handled by Stripe under its own terms; wallet payments additionally involve Apple or Google under theirs.

16. International Use & Worldwide Application

elebe is operated from Quebec, Canada. We make the site and products available to customers in many countries, but we make no representation that the content, products, or services are appropriate, available, or legal in every location. If you access the site from outside Canada, you do so on your own initiative and are solely responsible for compliance with all laws, regulations, taxes, duties, and import restrictions that apply where you live.

Regardless of the country from which you access the site or place an order:

• The disclaimers, limitation of liability, "as is" warranties, indemnification, and intellectual-property provisions in these Terms apply to you in full, worldwide, to the maximum extent permitted by the law applicable to you;
• You agree that these Terms and your relationship with elebe are governed by the laws of Quebec and Canada, as set out below, and you consent to that choice of law and forum;
• Where local mandatory consumer-protection law grants you rights that cannot be waived, nothing in these Terms removes those rights — but our liability remains limited to the fullest extent that law allows.

By using the site from any location, you accept that your personal information may be transferred to, stored in, and processed in Canada and other countries where our service providers operate, as described in our Privacy Policy.

17. Governing Law & Jurisdiction

These Terms are governed exclusively by the laws of the Province of Quebec, Canada, without regard to conflict-of-law rules. Subject to any non-waivable rights under the mandatory law of your country of residence, any disputes arising from these Terms or your use of the site shall be resolved exclusively in the courts of competent jurisdiction in Quebec, Canada, and you consent to the personal jurisdiction of those courts.

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
