1. Who We Are

elebe ("we", "us", "our") is an independent designer brand operating at elebe.ca. We create and sell original sticker art under the "A Filling Blanks Collection" and related series. We are not affiliated with any third-party marketplace, reseller, or distributor unless explicitly stated.

If you purchased from any source other than elebe.ca or an officially announced partner, we have no record of your order and cannot assist with it.

2. Acceptance of Terms

By visiting elebe.ca, browsing content, or completing a purchase, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, please do not use the site or place an order.

We reserve the right to update these Terms at any time. The revised version will be posted here with an updated effective date. Continued use of the site after changes constitutes your acceptance.

3. All Sales Are Final — No Returns or Refunds

Due to the handmade, limited, and collectible nature of our products, all sales are final. We do not offer returns, refunds, or exchanges except in the specific circumstances listed below.

We do not accept returns for: change of mind, buyer's remorse, incorrect size chosen, or dissatisfaction with a product that matches its listed description. Digital previews and photos are representative — minor colour variation due to screen calibration or print batch is expected and not grounds for a refund.

4. Products & Availability

All products are original art stickers produced in limited quantities. We reserve the right to discontinue, modify, or re-price any product at any time without prior notice. A listing on the site does not guarantee availability. In the event an ordered item is unavailable after purchase, we will notify you and issue a full refund for that item.

Product images are as accurate as possible, but slight colour and texture variation may occur between batches. This is a feature of handcrafted goods, not a defect.

5. Limitation of Liability

To the maximum extent permitted by applicable law in any jurisdiction worldwide, elebe, its owner, contributors, and any affiliated individuals are not liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising from:

• Your use of, or inability to use, this website;
• Any purchase, delivery, or product received;
• Delays, errors, or failures in shipping or logistics;
• Third-party payment processors, platforms, or services;
• Unauthorized access to or alteration of your data.

Our maximum liability to you for any claim related to a purchase is limited to the amount you paid for the specific item in dispute.

6. Disclaimer of Warranties

This website and all products are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the site will be uninterrupted, error-free, or free of viruses or harmful components. We do not warrant that product descriptions, images, or other content are accurate, complete, or current.

7. Intellectual Property

All content on this site — including artwork, logos, graphics, photographs, text, product designs, and the "A Filling Blanks Collection" identity — is the exclusive intellectual property of elebe or its creator, protected under Canadian and international copyright and trademark law.

You may not copy, reproduce, redistribute, sell, modify, or create derivative works from any content on this site without prior written permission. Personal, non-commercial sharing of product photos with proper credit is welcomed.

Purchasing a physical sticker does not transfer any intellectual property rights. You acquire the physical object only.

8. Shipping & Delivery

Estimated shipping times are provided in good faith but are not guaranteed. Once an order is handed to a carrier, delivery timelines are outside our control. We are not responsible for delays caused by customs, weather, carrier disruptions, or incorrect addresses provided at checkout.

It is your responsibility to provide an accurate shipping address. We cannot reship or refund orders lost due to an incorrect address provided by the customer.

9. User Conduct

You agree not to use this site to:

• Violate any applicable law or regulation;
• Impersonate elebe or misrepresent an affiliation with us;
• Interfere with or disrupt site infrastructure or security;
• Scrape, harvest, or extract data from the site in automated ways.

10. User-Generated Content

The site may, now or in the future, let you submit content — for example, messages sent through our contact form, reviews, comments, images, tags, names, scores, or anything else you upload, post, or transmit ("User Content"). You are solely responsible for your User Content and the consequences of submitting it.

By submitting User Content, you represent and warrant that:

• You own it or have all rights and permissions necessary to submit it;
• It does not infringe the intellectual property, privacy, publicity, or other rights of any person;
• It is not unlawful, defamatory, obscene, hateful, harassing, threatening, deceptive, or otherwise objectionable, and does not contain malware or solicitations.

Licence to us. You retain ownership of your User Content. By submitting it, you grant elebe a non-exclusive, worldwide, royalty-free, sublicensable, and transferable licence to use, host, store, reproduce, modify, display, and distribute that content in connection with operating, promoting, and improving the site and our products. You waive any moral rights in your User Content to the extent permitted by law.

No obligation to monitor; right to remove. We do not pre-screen User Content and are not responsible or liable for any User Content submitted by you or any third party. We may, but are not obligated to, monitor, edit, refuse to post, or remove any User Content at our sole discretion and at any time, for any reason, without notice.

Copyright complaints / takedown. If you believe content on the site infringes your copyright or other rights, email [email protected] with: a description of the work, the location of the allegedly infringing material, your contact information, and a statement that you have a good-faith belief the use is unauthorized. We will review and remove infringing material where appropriate, consistent with the U.S. DMCA and applicable Canadian law.

elebe disclaims all liability for User Content, including any errors, omissions, or losses arising from reliance on content submitted by users. Opinions expressed in User Content are those of the user, not elebe.

11. Indemnification

You agree to indemnify, defend, and hold harmless elebe, its owner, and any affiliated individuals from and against any claims, damages, liabilities, losses, costs, or expenses (including reasonable legal fees) arising out of or related to: (a) your User Content; (b) your use or misuse of the site; (c) your violation of these Terms; or (d) your violation of any law or the rights of any third party.

12. Third-Party Links & Services

This site may link to third-party websites, payment platforms, or social media. These are provided for convenience only. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party site or service.

13. International Use & Worldwide Application

elebe is operated from Quebec, Canada. We make the site and products available to customers in many countries, but we make no representation that the content, products, or services are appropriate, available, or legal in every location. If you access the site from outside Canada, you do so on your own initiative and are solely responsible for compliance with all laws, regulations, taxes, duties, and import restrictions that apply where you live.

Regardless of the country from which you access the site or place an order:

• The disclaimers, limitation of liability, "as is" warranties, indemnification, and intellectual-property provisions in these Terms apply to you in full, worldwide, to the maximum extent permitted by the law applicable to you;
• You agree that these Terms and your relationship with elebe are governed by the laws of Quebec and Canada, as set out below, and you consent to that choice of law and forum;
• Where local mandatory consumer-protection law grants you rights that cannot be waived, nothing in these Terms removes those rights — but our liability remains limited to the fullest extent that law allows.

By using the site from any location, you accept that your personal information may be transferred to, stored in, and processed in Canada and other countries where our service providers operate, as described in our Privacy Policy.

14. Governing Law & Jurisdiction

These Terms are governed exclusively by the laws of the Province of Quebec, Canada, without regard to conflict-of-law rules. Subject to any non-waivable rights under the mandatory law of your country of residence, any disputes arising from these Terms or your use of the site shall be resolved exclusively in the courts of competent jurisdiction in Quebec, Canada, and you consent to the personal jurisdiction of those courts.

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
